We have included two sets of policies, one for physical goods and one for digital goods and services. 


This website is operated by HypeStock.com. Throughout the site, the terms “we”, “us” and “our” refer to HypeStock.com. HypeStock.com offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

We reserve the right to limit the quantities of any products or Services that we offer. We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

5. Content Removal

  • HypeStock.com reserves the right, but has no obligation, to remove or disable access to any Content at any time and for any reason, including but not limited to Content that violates these Terms, applicable laws, or third-party rights.

6. Refunds and Returns Policy

  • Due to the digital nature of the Content, all sales are final. However, refunds or exchanges may be considered in certain circumstances, such as technical issues preventing download or if the Content is demonstrably defective. 7. Prohibited Conduct

  • This section was already well-defined in the previous paragraphs. 

8. Termination of Access

  • HypeStock.com may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account.

9. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

10. Dispute Resolution

  • Any dispute arising out of or relating to these Terms, or the breach thereof, shall be resolved through binding arbitration in Santa Rosa, California, conducted under the rules of the American Arbitration Association.

11. Changes to the Terms

  • HypeStock.com reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 10 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.

 

DIGITAL PRODUCT LICENSE AGREEMENT

EFFECTIVE DATE: Ongoing

This Digital Product License Agreement ("Agreement") sets forth the terms under which HypeStock.com ("Licensor") grants usage rights for digital images, eBooks, and PDF downloads purchased from our store. By purchasing and downloading our digital products, you ("Licensee") agree to the following terms:

1. GRANT OF LICENSE

Upon purchase, Licensor grants Licensee a non-exclusive, non-transferable, and non-sublicensable license to use the digital product(s) for the permitted uses outlined below.

2. PERMITTED USES

Licensee may use the purchased digital product(s) for:

  • Personal Use: Reading, referencing, studying, or displaying the content.

  • Print-on-Demand (POD) Use: Printing digital images for resale as posters, prints, or other physical products.

3. PROHIBITED USES

Licensee may not:

  • Resell, redistribute, sublicense, or share the digital product(s) in their original or modified form.

  • Claim authorship or ownership of the digital product(s).

  • Use the digital product(s) in any way that is illegal, defamatory, or infringes on any third-party rights.

  • Upload the digital product(s) to public forums, file-sharing sites, or any distribution platform.

4. INTELLECTUAL PROPERTY RIGHTS

All digital products remain the intellectual property of Licensor. Licensee obtains no ownership rights by purchasing a license.

5. LIABILITY & INDEMNIFICATION

Licensor is not liable for any claims, damages, or losses resulting from the use of the digital products. Licensee agrees to indemnify and hold harmless Licensor from any claims arising out of their use of the digital products.

6. TERMINATION

This license is valid indefinitely unless Licensee violates any terms. In such cases, the license is revoked immediately, and Licensee must cease using the digital products.
